Company Fined $2,000 For Worker’s Death In Indiana

An Evansville, Indiana, manufacturing company has been fined by Indiana’s Department of Labor in connection with the death of a worker in August of 2010. According to reports from Channel 13 News, the company responsible for the death, Bootz Industries, was fined $2,000 by the department for their part in causing the accident.

Records show that the 49-year-old worker was killed when a forklift he was driving hit a sidewalk and flipped over on top of him. It was determined that the worker was not wearing a seat belt and may not have been safe to operate because of leaking fluid lines. These findings prompted the Indiana Department of Labor to investigate, who mandated a $3,500 fine to the company. The fine was later reduced to $2,000 after the company agreed to take the forklift out of service and retrain drivers on forklift safety and use in the next 30 days.

No civil action has been taken against the company in connection with the death of the worker, but the statute of limitations on wrongful death cases is two years.

Indiana Community College Professor Falls From Tower

A new faculty member at the Lafayette, Indiana, campus of Ivy Tech Community College died Wednesday after falling from a tower on the campus while instructing students. FOX 59 News reports the 70-foot tower is used to train students how to climb up and down a wind turbine as part of the sustainable energy curriculum at the school.

The 36-year-old professor was leading a “rating exercise” with students around noon when the accident happened. Investigators are unsure what happened, but say the instructor fell from the top of the tower in front of the students. Paramedics were immediately contacted, but were unable to revive the man and he was declared dead at the scene.

The accident shows the dangers that jobs working in high places can be dangerous. Oklahoma Man Killed in Indiana Crash with Semi-Truck

A 36-year-old male from Purcell, Oklahoma, died on Thursday, October 13, in Plainfield, Indiana, when his pickup truck ran into the back of a semitrailer truck on I-70, reports The Indianapolis Star.

According to Indiana State Police Sergeant Rich Myers, the accident occurred around 4:50 p.m. as the man was traveling west in a 2010 Chevrolet pickup truck at Indiana 267. Traffic had reportedly slowed in a construction zone but the Chevrolet’s driver failed to decrease his speed. He slammed into the rear of the semi.

The victim died at the scene. Neither person inside the semi-truck was injured.

The accident closed all lanes to westbound traffic for three hours.

The victim is survived by his wife and three children, reports The Norman Transcript. He is to be buried on Wednesday at the First Baptist Church in Purcell.

Evansville Man Dies in Fall at Illinois Recreation Area

August 30, 2011

An Evansville, Indiana, man lost his life in a fatal fall at Illinois’s scenic Garden of the Gods recreational area in the Shawnee National Forest on Sunday, August 28.

The Daily Register reports that the victim is 44-year-old Darrell Brackett, who fell from a rock formation on which he was climbing. The accident happened shortly before 12:40 p.m., which is when Saline County Central Dispatch received a 9-1-1 call about the fall.

The man had apparently fallen while climbing near Garden of the Gods’s Chimney Rock. A Saline County Sheriff’s Department news release indicates that the victim fell 75 to 100 feet to his death.

The Gallatin County Emergency Medical Service, Equality Fire Department, Saline County Sheriff’s Department, Air Evac, and the Department of Conservation all sent emergency responders to the scene to help with the rescue.

The man, however, was pronounced dead at the accident site by a Saline County Coroner at 2 p.m.

Garden of the Gods is located about 15 miles southeast of Harrisburg, Illinois.

Prosecutors blame many in South Bend wrongful death lawsuit

The South Bend Tribune reports that prosecutors are suggesting the South Bend owner of an SUV involved in the death of a South Bend police officer may be held liable.

According to details in the case, the South Bend SUV owner lent his uninsured vehicle to the drunk driver who caused the South Bend auto accident. Prosecutors believe the South Bend SUV owner should be held liable in the South Bend wrongful death lawsuit based on their claim that he lent the vehicle knowing that the driver was incompetent.

Others named in the suit are the driver who caused the accident, and the Mishawaka bar where the driver drank before the South Bend auto accident occurred.

Bank teller files Indianapolis wrongful death suit

The Indianapolis Star reported that a bank teller filed a suit against Huntington Bank claiming the bank was negligent for the death of her twin children.

The woman, who filed the Indiana wrongful death suit, was a teller at the bank when she was shot in the abdomen by a robber. She was approximately six months pregnant with twins at the time of the shooting, and went into labor two days later.  One twin was stillborn and the other died several hours after birth.

The Indianapolis wrongful death suit claims the bank was negligent in that it provided only basic robbery training, lacked security officers, and failed to install bulletproof glass.

The suit also seeks damages under Indiana’s Child Wrongful Death Act.

Indiana family files wrongful death suit

March 25, 2008

According to the Post-Tribune, the family of a Methodist Hospitals’ Alzheimer’s patient, who died in February, has filed a wrongful death claim against the hospital.

The 83-year-old Gary wrongful death victim wandered away from her room in the Indiana hospital and was later found dead; her body was found nearly one mile down the road.

Family members of the patient blame the hospital for gross negligence in the death of their relative.

A ruling has been yet to be made in the Gary wrongful death case.
